TERMS AND CONDITIONS 

Prospective clients, like clients, may utilize the submission/inquiry function of Cole Scott & Kissane’s (“CSK”) website to contact the firm for purposes of engagement for the rendering of legal services. CSK is a law firm, practicing in the State of Florida. Any inquiry and request for legal advice through the CSK website (www.csklegal.com) is not viewed by the Firm as a formation of engagement and an attorney-client relationship. At the time of inquiry, CSK has not had an opportunity to meet with any prospective client or conduct a conflict of interest. Nor does CSK have advance notice of any potentially privileged and confidential information that may be shared by a prospective client through its website. In accordance with Rule 4-1.18, Rules Regulating the Florida Bar, CSK will receive any information that may be provided through its website and will take necessary steps to ensure confidentiality as if there was a limited attorney-client relationship, and if necessary, dispose immediately of any information provided. A prospective client may unilaterally, without prior notice, disclose information to a lawyer, place documents or other property in the lawyer's custody, or rely on the lawyer's advice, prior to formal engagement and rendering of legal services. Similar to a lawyer's consultations with a prospective client usually being limited in time and depth, leaving both the prospective client and the lawyer free (and sometimes required) to proceed no further, any inquiry received by CSK through its website is viewed as the same.  Before any website submission, an individual submitting any inquiry – whether a prospective client, or not – hereby understands and agrees to the foregoing. The individual (or prospective client) further agrees by acknowledgment and receipt of the Terms and Conditions as a pre-requisite to online submission that by any submission, the individual, hereby grants CSK the authority to review any information provided. The materials reviewed may include sensitive information. The individual (or prospective client) grants CSK the right to discuss this case internally with attorneys and any other persons. The individual (or prospective client) further understands and agrees that no attorney-client relationship will be established until the execution of a formal written Retainer Agreement by both the prospective client and CSK. However, an attorney-client relationship does exist to the extent that any communications between the potential client and members of the Firm are protected as confidential, and on a limited basis pending engagement and clearance of conflict of interest, by the attorney-client privilege.

By this agreement, the individual (or prospective client) and CSK agree that CSK will undertake no responsibility for the representation of the client until the execution of a formal written Retainer Agreement by both the prospective client and CSK. For example, the prospective client and CSK agree that CSK assumes no responsibility for determining and preventing the expiration of any deadlines, including the running of any applicable statute of limitations. CSK assumes no responsibility to complete the review within any particular period of time. CSK is under no obligation to take the prospective client's case and the prospective client is under no obligation to retain the Firm.

The individual (or prospective client) and CSK agree that CSK will not be responsible for the retention or safety of any medical records, correspondence, notes, pictures, radiographic films, evidence, and other items provided to the firm for review through any online submission. The individual (or prospective client) and CSK agree that the individual (or prospective client) assumes the risk of loss or destruction of any item provided to CSK.

The parties agree that the exclusive jurisdiction and venue for any action arising out of this agreement or this representation shall be in Miami, Florida, governed by the laws of the State of Florida. If any of the provisions of this document are deemed illegal, unlawful, or invalid, they are hereby severed from this agreement and the remainder of this agreement remains in full force and effect. This document contains the entire agreement of the parties and there are no separate oral agreements.
