Tampa Partner David Borucke, along with Tampa Partners Aram Megerian and William Kirilloff, recently obtained an excellent Summary Judgment order and subsequent PCA in a legal malpractice case. The case involved CSK’s client, a Ft. Myers law firm, missing a deadline to submit medical information related to ERISA claim that was ultimately filed in Federal Court. Plaintiff argued, among other things, that this led to the denial of his claim for LTD benefits and him also losing the Federal Action. The team was able to show that the medical information and the missing of the deadline had no effect on the claim itself and that Plaintiff could not show the required proximate cause to bring a claim for professional malpractice.
