Miami Partners, Haley Kornfield and Jonathan Midwall obtained summary judgment for a condominium association and its management company in slip and fall case in Miami-Dade County. Plaintiff allegedly slipped and fell on a spill emanating from a storage unit into the common aisles of the storage facility in the condominium. The Plaintiff was claiming that CSK’s clients were responsible for his shoulder and knee surgery. There were over $300,000 in past medical bills and a proposed life care plan for over $840,000. The Court ruled that there was insufficient evidence to conclude that CSK’s clients had actual or constructive notice in order to be held liable.
