Slip and Fall Favorable Verdict – Seminole County

Orlando Partners Michael Merrill and Scott Shelton obtained a great trial result in Seminole County against a large and well-known Plaintiff firm on behalf of a chain retail store.

The Plaintiff was a 75-year-old customer who slipped and fell in an aisle and broke her kneecap into multiple pieces. She subsequently underwent surgery and was later recommended to undergo knee replacement surgery.

Liability was admitted for unique reasons and comparative fault was not an issue decided by the jury. Plaintiff’s initial injury was also conceded though we contested the need for future care. The defense did not call any witnesses.

Plaintiff asked the jury for approximately $3.2 million dollars but, after approximately two hours of deliberations, the jury returned a verdict of $175,000.
