Case Summary
This medical negligence case arose from a series of hospitalizations following the Plaintiff’s ruptured appendix. The Plaintiff alleged that the Defendant hospital failed to properly treat his infection, leading to the development of sepsis and the formation of blood clots that ultimately caused multiple strokes. The Plaintiff further claimed that the hospital was vicariously liable for the alleged negligence of the treating surgeon and directly liable for the care provided by its nursing staff.
According to the Plaintiff, these events resulted in permanent and total disability, as well as related damages, including loss of consortium with his minor child.
Defense Strategy
The CSK Defense Team focused on causation and the complexity of the Plaintiff’s medical condition. Evidence showed that the Plaintiff had multiple pre-existing conditions that independently increased his risk of stroke. The Team also demonstrated that numerous treating physicians and retained experts were unable to reach a consensus regarding the cause of the Plaintiff’s strokes.
In addition, the defense relied on medical records to rebut the allegations of negligence, showing that the Plaintiff was never septic and did not develop any acute blood clots following his appendectomy. These records directly contradicted the Plaintiff’s theory of causation and underscored the lack of objective medical evidence supporting his claims.
Outcome
After trial, the jury returned a complete defense verdict. The jury found that the surgeon was not an agent of the Defendant hospital and that there was no negligence on the part of the hospital’s nursing staff.
Because the jury found no liability, it did not consider the Plaintiff’s claimed damages. The verdict underscores the importance of addressing causation in complex medical negligence cases involving multiple risk factors, extensive medical histories, and competing expert opinions.
