Case Summary
This case arose from a rear-end motor vehicle accident that occurred in 2022. The Defendant admitted liability for the crash, while the Plaintiff sought damages for alleged injuries and related medical treatment. At trial, the Plaintiff presented approximately $180,000 in past medical expenses and claimed roughly $700,000 in future medical costs based on a life care plan. Although liability was not disputed, the central issue was whether the accident legally caused the injuries and damages claimed by the Plaintiff.
Defense Strategy
After assuming the case shortly before trial, the CSK Defense Team focused its strategy on causation rather than liability. Because liability for the accident had already been admitted, the Team concentrated on challenging the connection between the accident and the Plaintiff’s alleged injuries, ongoing treatment, and future care claims.
During cross-examination, the defense questioned the Plaintiff regarding the nature, timing, and extent of the medical treatment. Based on the testimony presented and the evidentiary record, the defense made the strategic decision not to call any retained experts. Instead, the defense relied on the Plaintiff’s own testimony to argue that the alleged injuries and extensive treatment were not attributable to the accident.
Outcome
After approximately 20 minutes of deliberation, the jury returned a complete defense verdict. The jury found that although the Defendant was involved in the accident, the negligence was not a legal cause of any loss, injury, or damage claimed by the Plaintiff. As a result, no damages were awarded.
This outcome underscores the importance of focusing on causation in cases where liability is admitted, particularly when substantial medical expenses and future care claims are at issue. The verdict demonstrates that even in admitted liability cases, a well-executed defense can successfully challenge whether the accident caused the alleged injuries.
