Congratulations to Orlando Associate Allaa Tayeb for drafting and prevailing upon two Motions for Summary Judgment (MSJ).
The first MSJ in Osceola County was granted in favor of our client, a homeowners’ association, on a homeowner’s challenge to a special assessment. The court found the evidence established that the special assessment was properly passed, and there was no evidence of coercion or otherwise invalid actions taken by the association in passing the special assessment. Special thanks to Orlando Associate Guive Rosen for graciously stepping in to argue the motion.
The second MSJ was in Brevard County and was granted in favor of our client, a condominium association, on strict liability and negligence claims related to injuries sustained in an alligator attack on a homeowner’s property. The court found our client did not own, control, or maintain the portion of the property where the Plaintiff was injured. Rather, the evidence demonstrated the Co-Defendant owned the property. A true team effort, Orlando Administrative Partner Jeffrey Partlow assisted with arguing the motion.
