Case Summary
This medical malpractice lawsuit arose after a minor allegedly lost consciousness during allergy testing, fell, and sustained a traumatic brain injury. The Plaintiff filed suit against the treating allergist and the physician's former medical practice in Miami.
Rather than focusing on the underlying negligence allegations, the case centered on the Plaintiff's compliance with Florida's mandatory presuit requirements.
Defense Strategy
The CSK Defense Team identified several deficiencies in the Plaintiff's presuit compliance, including a Notice of Intent sent to the allergist's former practice address, an improperly verified expert affidavit, and the failure to provide proper notice of claims against the medical practice. After notifying opposing counsel of these deficiencies, the Team filed a motion to dismiss, arguing that the Plaintiff had failed to satisfy Florida's mandatory presuit requirements and that the statute of limitations had expired.
The Team also opposed the Plaintiff's subsequent motion for rehearing and efforts to pursue additional discovery, maintaining that the remaining question concerning service of the Notice of Intent would not overcome the other grounds for dismissal.
Outcome
The Court initially dismissed the lawsuit with prejudice, agreeing with the defense arguments regarding the presuit deficiencies and expiration of the statute of limitations. Following the Plaintiff's motion for rehearing, the Court permitted a limited evidentiary hearing concerning service of the Notice of Intent but maintained its earlier findings on the remaining issues.
After the Defense Team explained that the evidentiary hearing could require testimony from Plaintiff's counsel and would not overcome the remaining grounds for dismissal, the Plaintiff agreed to voluntarily dismiss all claims against the Defendants with prejudice in exchange for their agreement not to pursue taxable costs. The litigation concluded without any recovery against the Defendants.
The result highlights the importance of early identification of procedural deficiencies and strategic motion practice in resolving medical malpractice litigation.
