Case Summary
This case arose from an unsuccessful waterfront home purchase in Broward County. The Plaintiff, a prospective homebuyer, filed a federal lawsuit seeking damages from several parties involved in the transaction, including a Defendant real estate brokerage firm represented by CSK, along with lending and other real estate-related entities.
Before the federal lawsuit was filed, a related case in state court had resulted in a judgment against the Plaintiff. That matter remained on appeal while the Plaintiff pursued the federal case.
Defense Strategy

The record showed that parties on opposing sides of the lawsuit were citizens of the same state. For this type of case to be heard in federal court, the Plaintiff and each Defendant must be citizens of different states. Because that requirement was not met, the Court determined that it did not have authority to hear the dispute.
Outcome
The Court dismissed the lawsuit without prejudice and closed the case. The decision ended the Plaintiff’s current federal action against the Defendant real estate brokerage firm without the Court having to decide the claims related to the failed home purchase.
The decision highlights the importance of determining at the outset whether a lawsuit has been filed in the proper court. Addressing that issue early can prevent the parties from spending additional time and resources litigating a case that the Court does not have authority to hear.
