Favorable Verdict in Admitted Liability Auto Accident Case in Miami-Dade County

Miami Partners Sam Basch and Tiffany Batten received a favorable verdict in an admitted liability case in Miami-Dade County.

The automobile accident caused our client’s truck to push a scooter and its rider approximately 40 feet through an intersection. From the outset, responsibility for the crash was acknowledged, and both sides agreed the injuries sustained by the scooter rider were a direct result of the accident. Physicians confirmed that the individual’s past medical expenses, totaling $36,000, were reasonable and connected to the incident.

The central issue in the courtroom shifted to the potential for future medical costs and compensation for pain and suffering. Medical records referenced recommendations for two possible future surgeries. According to the defense’s expert, the Plaintiff had not suffered any permanent harm.

Despite this, the court determined that the Plaintiff’s own statements about ongoing pain two years after the accident were sufficient grounds for the jury to consider whether a lasting injury existed.

During closing arguments, the Plaintiff’s team requested $300,000 for economic losses, and pain and suffering. Our position was that only the actual, documented medical costs of $36,000 should be awarded, with nothing further for possible future expenses or discomfort.

After deliberating for just 90 minutes, the jury awarded the Plaintiff $84,000.
