Defense Verdict on Behalf of HOA Members – Volusia County

Orlando Partner Jeffrey Partlow and Orlando Associate Carita Skinner obtained a defense verdict in a Volusia County jury trial on behalf of three condominium board members. Plaintiff operated a hotel within a condominium in Daytona Beach Shores and brought claims for tortious interference and breach of fiduciary duty against three of the condominium association’s board of directors based on condominium owners renting their units outside the hotel and not taking action to enforce the covenants.

Jeff and Carita obtained summary judgment on the tortious interference claims for two of the board members before trial and obtained a directed verdict on this same claim for the third board member. Only the breach of fiduciary duty claims were submitted to the jury. After more than 3 hours of deliberation, the jury returned a complete defense verdict in favor of all three board members.
