Jacksonville Partner Victoria Merritt and Orlando Partner Scott Shelton received a defense verdict in Clay County in a rejected tender case against a local well-known Plaintiff’s firm.
Plaintiff was rear-ended by our clients in 2017, which caused moderate damage to both vehicles. Plaintiff was treated at the emergency room the same day and then started chiropractic care shortly thereafter undergoing over 15 rounds of various injections to various parts of her spine between 2017 and 2024 lower back surgery.
Plaintiff boarded approximately $200,000 in past medical expenses and had a Life Care Plan that exceeded $800,000. Plaintiff also called ten witnesses during trial before asking for over $2 million during closing arguments.
After three hours of deliberations, the jury returned a verdict for only $10,000 and a finding of no permanency which was close to one of the amounts suggested during Defendants’ closing.
