Defense Verdict - Auto Accident with Injuries - Seminole County

Orlando partners Michael Merrill and Scott Shelton received a complete defense verdict in Seminole County against a large and well-known Plaintiff’s firm.

The case was a disputed liability case involving a car accident on Interstate 4 where Plaintiff alleged the Defendant’s large commercial vehicle changed lanes and rear-ended/side-swiped her vehicle while approaching an exit. Following the impact, Plaintiff’s vehicle spun around several times coming to rest in the travel lanes and facing oncoming traffic.

Shortly after the accident, Plaintiff began treating with a chiropractor and then continued treatment with numerous doctors who performed various procedures on her neck / back. Her doctors also testified she needed significant surgery to both her neck and back in future care. Plaintiff did not have any documented complaints or treatment for these issues before the accident.

After the Plaintiff rested her case, the defense withdrew their experts and only called their Defendant, driver to testify. Plaintiff asked for a significant award for past and future medical expenses and pain and suffering during closing arguments. The jury was out for approximately 40 minutes before returning a complete defense verdict.
