Miami Partners David Herrero and Mike Brand obtained a complete defense verdict on an admitted liability auto case in Miami. Their client rear-ended the plaintiff in a pickup truck, causing the airbags to deploy in both vehicles and totaling both cars. Plaintiff thereafter had a knee surgery and was recommended for a total knee replacement and shoulder surgery. After a trial four years ago resulting in a $30k verdict, plaintiff appealed on an evidentiary issue and the case was reversed. This time, the jury found no permanency and no damages were awarded.
