Miami Partners David Caballero, Sean Hernandez, and Alejandro Cura received a complete defense verdict in a four-day trial in Broward County. The case centered around a rideshare driver who accidentally crashed into a metal pole while a passenger was in the car.
Although the driver admitted fault for causing the accident, the main issue was whether the passenger’s injuries, and the large medical bills, were the driver’s responsibility. The passenger, a 38-year-old woman, required significant medical treatment, including a two-level back surgery, and her doctors stated she might need further surgeries in the future. Her attorneys asked the jury for $10 million in compensation.
The situation was complicated by the fact that the passenger had been in several previous accidents. After listening to both sides present their cases over four days, the jury decided that the driver was not responsible for the passenger’s injuries and did not owe any money in damages.
