Voluntary Dismissal in Admitted Liability Case in Miami-Dade County

Miami Partners David Caballero, Alejandro Cura, Associate Samir Chebat,and their team obtained a mid-trial voluntary dismissal in an admitted liability case in Miami-Dade County. This was a pre-tort reform case with combined bills of just under $200,000. Plaintiffs were stopped at a red light intersection when they were lightly rear-ended by the Defendant. One Plaintiff underwent total disk replacement. and the other a cervical diskectomy.

On the second day of trial, halfway through the cross examination of the first Plaintiff, opposing counsel offered to voluntarily dismiss the case with each party agreeing to bear their own costs. This was particularly interesting as it was the first time our firm has encountered a dismissal in the middle of Plaintiff cross-examination.
