West Palm Beach Partner Katie Merwin obtained summary judgment on behalf of a property owners association and its former director/dockmaster.
The Plaintiffs asserted claims for Negligent Misrepresentation, Specific Performance, and Declaratory Relief against the Association arising from what they believed to be an invalid rule which prevented seasonal residents from leasing one of the limited boat slips available to Association members.
The Plaintiffs also asserted claims against the Association’s former dockmaster for breach of fiduciary duty, claiming he engaged in self-dealing and otherwise improperly enforced the Association’s residency restriction. The Court previously dismissed four other directors named individually in the litigation.
The Court granted Defendants’ motion for summary judgment and entered a final decision in favor of all Defendants regarding each claim raised by the Plaintiffs.
