Orlando Partner Jeffrey Partlow obtained a Summary Judgment in favor of a realtor.
After purchasing a home in Lake County, Plaintiff brought suit against the seller’s realtor for fraudulent misrepresentation, claiming defects with the roof, pool, fireplace, HVAC, plumbing, and kitchen should have been disclosed prior to closing. CSK moved for summary judgment on the claims against the realtor because the realtor’s statements about the property were true and Plaintiff did not rely to his detriment on any statements made by the realtor. The court agreed and granted summary judgment in favor of the realtor.
