Summary Judgment in Favor of HOA – Indian River County

Orlando Partner Jeffrey Partlow obtained a summary judgment in favor of his client, a homeowners’ association in Indian River County.

Plaintiffs were a group of boat slip assignees in Indian River County who brought claims against a homeowners’ association for declaratory judgment and breach of fiduciary duty, to challenge the amount of boat slip assessments. The court granted CSK’s client summary judgment because it properly exercised its business judgment in calculating boat slip assessments and there was no evidence the method of calculation was improper under the terms of the governing documents.
