Summary Judgment Granted – Dirt Bike Track Injury - Jacksonville

Jacksonville Associate Alexandra Dabek obtained summary judgment on an injury case which arose from a minor who was racing at a dirt bike track and was injured.

As a condition of Plaintiff’s minor son participating in the race, Plaintiff executed a waiver and release. The language of the release stated the guardian was “giving up your child’s right and your right to recover in a lawsuit for any personal injury.” Plaintiff argued ambiguity as to the language of the waiver. The court disagreed, upheld and enforced the waiver and granted summary judgment.
