Case Summary
This case arose from a serious rear-end motor vehicle collision involving a tourist visiting from New Jersey. The Plaintiff, who had no prior injury history, was stopped when his vehicle was struck from behind at high speed by the Defendant’s luxury sports car. Both vehicles sustained significant damage, including intrusion into the Plaintiff’s passenger compartment.
Following the crash, the Plaintiff alleged neck and back injuries and sought compensation for approximately $400,000 in medical expenses. The Defendant carried a $100,000 insurance policy, which was tendered early but rejected. The Plaintiff ultimately demanded $1.5 million to resolve the case and proceeded to trial represented by a large national plaintiffs’ firm.
Defense Strategy
The CSK Defense Team admitted liability for the collision, allowing the trial to focus on the nature and extent of the Plaintiff’s alleged injuries. The defense argued that, despite the severity of the crash, the Plaintiff’s injuries were temporary and did not result in permanent impairment. Through medical evidence and expert testimony, the defense challenged the necessity and duration of the Plaintiff’s treatment and disputed claims of long-term or future medical needs.
In closing argument, the defense emphasized the absence of permanent injury and urged the jury to return a verdict consistent with the evidence, recommending an award of $75,000 rather than the amount sought by the Plaintiff.
Outcome
After approximately two hours of deliberation, the jury returned a verdict awarding approximately 2.6% of the amount requested by the Plaintiff, with no future medical expenses and a finding of no permanent injury. The award matched the defense’s recommendation and will be further reduced by applicable setoffs.
This result validated the defense position that damages must be driven by medical evidence rather than the severity of the impact, and that the Plaintiff’s injuries were temporary and did not justify a substantial award.
