Okaloosa County Premises Liability Final Summary Judgment

Pensacola Partner, Grayson Miller, obtained final summary judgment in favor of a hotel client.

Plaintiff was an invitee staying at a client’s hotel in Okaloosa County and was visiting from South Florida for her nephew’s wedding. Plaintiff tripped and fell underneath under the hotel’s car port while leaving the hotel to head towards her vehicle at the junction where the concrete sidewalk joined the brick pavers.

Plaintiff alleged the joint was uneven and constituted an unreasonable dangerous condition and caused her fall while Defendant countered the height differential at the joint was so minimal as not to constitute an unreasonably dangerous condition as a matter of law. The trial court agreed with Defendant, held the condition of the premises was non-negligent as a matter of law, and entered summary final judgment in favor of Defendant.
