Miami-Dade County Jury Finds No Coverage Owed for Claimed Hurricane Ian Damage

Case Summary
This case arose from a property insurance dispute involving alleged damage from Hurricane Ian. The Plaintiffs claimed that the hurricane damaged the roof of their home, resulting in water entering the property, and sought coverage from the Defendant property insurance company.

Defense Strategy
During cross-examination, the CSK Defense Team presented photographs from 2016 showing water intrusion in the garage, which contradicted the Plaintiff's testimony that he had not observed interior water intrusion before the hurricane.

The defense also examined the Plaintiffs' expert analysis of the roof damage. Defense expert testimony established that the roof tiles were heavier than those used in the Plaintiffs' calculations, raising questions about whether the hurricane's winds were strong enough to cause the alleged damage.

Outcome
Following a three-day trial and approximately one hour of deliberation, the jury rejected the Plaintiffs' claims. The Court entered final judgment for the Defendant property insurance company, with no recovery for the Plaintiffs, and reserved jurisdiction to determine any recoverable fees and costs.

The outcome reinforces the importance of closely examining expert opinions, testing the basis of claimed storm damage, and reviewing a property's history for conditions that may have existed before the reported loss.
