Case Summary
In March 2022, during heavy traffic on I-275 in Hillsborough County, the Defendant, a company, admitted to rear-ending a vehicle that was pushed into the Plaintiff’s car. Despite minimal property damage, the Plaintiff began treatment four days later and continued conservative care through trial, including two sets of lower back injections a year post-accident. With no prior neck or back issues, the Plaintiff sought $58,000 in past medical costs, $100,000 for future care, and $200,000–$600,000 in pain and suffering.
Defense Strategy
The CSK Defense Team emphasized that this was a low-impact accident, demonstrating that all medical treatment was performed under Letters of Protection (LOPs) and that there was no objective evidence of acute spinal injury resulting from the crash.
Verdict
After just 45 minutes of deliberation, including lunch, the jury returned a verdict of $16,860—the exact amount proposed by the defense. The result was a major win for the Defendant and their insurance carrier.
