Case Summary
This case arose from allegations that a garage door operated by an employee of a large retail defendant struck the Plaintiff, resulting in claimed traumatic brain injury and the need for cervical surgeries. The Plaintiff further alleged ongoing mobility issues, sensitivity to light, and chronic migraines, and her spouse asserted a loss of consortium claim.
Defense Strategy
The CSK Defense Team took over the case shortly before trial and focused on challenging the Plaintiff’s medical causation theories and escalating damages demands, which ultimately grew to a $40 million request to the jury.
The defense delivered a clear and grounded opening statement that framed the case around unsupported medical opinions and inflated damages claims. Through strategic cross-examination of the Plaintiff and her medical experts, the defense exposed inconsistencies in the injury narrative and highlighted gaps in causation testimony.
By presenting a unified and disciplined case theory across offices, the team effectively dismantled the Plaintiff’s high-value claims.
Outcome
The jury deliberated for just over an hour before returning a full defense verdict, finding that the retail defendant was not negligent and awarding no damages.
After rejecting negligence at the first question on the verdict form, the case concluded immediately with no need for additional findings. The result reflects the strength of the defense presentation and the jury’s conclusion that the evidence did not support the Plaintiff’s high-value injury claims.
