Final Summary Judgment in Premises Liability Case in Sarasota County 

Fort Myers Partner Brian Williams and Associate Daivd Josey obtained a final summary judgment in favor of our client in Sarasota County on a premises liability case where the Plaintiff claimed to have tripped and fallen over a hazardous step leading out of our client’s store. The Court ruled that our client owed no duty to the Plaintiff as a matter of law.

The Plaintiff alleged that the step leading out of our client’s store was a dangerous condition that our client failed to warn about or correct.

The defense argued that the Plaintiff had been to the store and navigated the step before, that there was no evidence of disrepair, and that there was a “Caution Watch Your Step” sign on the front door visible as patrons entered the store. Given these facts, it was argued that the step in question was not a dangerous condition and was open and obvious.
