Duval County Jury Returns Defense Verdict in Auto Negligence Case

CSK Defense Team
Jacksonville Partner Victoria Merritt
Miami Partner Richard Adams

Case Summary
This case arose from a 2022 motor vehicle accident in which the Plaintiff alleged that a Defendant driver’s negligence caused neck injuries and a traumatic brain injury. The Plaintiff sought significant damages for past medical expenses and future treatment, including additional surgery.

Defense Strategy
Although liability for the accident was admitted, the CSK Defense Team focused on causation and disputed whether the collision was responsible for the Plaintiff’s alleged injuries and extensive medical treatment. The defense closely analyzed the medical records, challenged the necessity and causation of the claimed treatment, and highlighted inconsistencies in the evidence presented at trial. Particular emphasis was placed on the importance of primary care records and the evaluation of the Plaintiff’s claimed medical expenses.

Outcome
After approximately one and a half hours of deliberation, the jury returned a complete defense verdict, finding that the Defendant’s negligence was not the legal cause of the Plaintiff’s alleged injuries and damages.

The result highlights the importance of a focused causation defense and careful evaluation of medical evidence in admitted liability cases.
