Tampa Partner Lauren Kilgore and Ft. Lauderdale Partner Jose Campos secured a complete defense verdict in Seminole County.
Plaintiff was a homeowner who filed a water claim as a result of a pipe leak. The carrier paid for water damages but Plaintiff sought coverage for tear out to access and replace the entire cast iron system. Defense argued that the entire issue could be repaired by fixing the septic tank outside the home and that trenching the home was unnecessary.
Plaintiff’s counsel was from a large and well-known law firm who has been at the forefront with cast iron pipe cases.
After deliberating for a little over an hour, the jury returned a complete defense verdict finding that trenching to replace the pipes was completely unnecessary.
