Case Summary
This civil case was brought in Florida state court by corporate cleaning and linen service Plaintiffs against an individual Defendant following a motor vehicle accident involving a work van. The accident resulted in injuries to multiple employees of the Plaintiffs’ corporations, and the Plaintiffs paid workers’ compensation benefits as required by law.
After paying those benefits, the Plaintiffs filed an amended complaint against the Defendant seeking reimbursement under Florida’s workers’ compensation lien statute, Chapter 440.39, along with additional alleged statutory violations and common law claims. In total, the amended complaint asserted nine counts against the Defendant.
Defense Strategy
The CSK Defense Team focused on challenging the legal sufficiency of the Plaintiffs’ amended complaint at an early stage of the litigation. Rather than engaging in extended discovery or factual disputes regarding the accident, the defense relied on targeted motion practice to test whether the Plaintiffs’ lien enforcement theories and related allegations were legally viable under Florida law.
By addressing the statutory framework governing workers’ compensation liens and the pleading requirements applicable in circuit court, the defense positioned the case for early judicial review and resolution based on the governing law rather than prolonged factual development.
Outcome
The Court granted the Defendant’s motion to dismiss, resulting in a significant defense victory and early resolution of the case’s most substantial claims. One count was dismissed without prejudice, while counts 2 through 9 were dismissed with prejudice, permanently ending the majority of the Plaintiffs’ claims.
The ruling substantially reduced the scope of the litigation and brought finality to the workers’ compensation lien enforcement allegations at issue. This outcome highlights the value of early, focused motion practice in civil defense matters—particularly those involving statutory lien claims—and demonstrates how a well-executed legal challenge can resolve high-exposure claims before a case advances into costly and time-consuming stages of litigation.
