Court Dismisses Claims in Alleged Wrongful Burial Case in Pensacola, FL

Case Summary
Plaintiffs brought a federal lawsuit in the Northern District of Florida against several Defendants including a funeral home company and its principal, the Florida Department of Corrections (DOC), and various individual jail employees. The case involved 19 different causes of action and sought punitive damages and attorneys’ fees against the funeral home defendants.

Defense Strategy
In response to Plaintiffs’ Complaint, the CSK Defense Team filed a Motion to Dismiss arguing that Plaintiffs’ claims were barred by various provisions in Chapter 497, Florida Statutes with which the funeral home complied despite allegations to the contrary and claims that their clients owed duties outside the statutory scheme.

The CSK Defense Team secured a dismissal with prejudice for their funeral home clients.
