Case Summary
This case arose from a property insurance dispute involving a Brevard County home following Hurricane Irma. The Defendant property insurance company opened coverage for damage to the roof, while the Plaintiff claimed that the storm also caused damage to the home's tile flooring. The Plaintiff sought more than $150,000 in damages, along with attorneys' fees and costs.
The disputed flooring damage became the central issue in the litigation.
Defense Strategy
The CSK Defense Team obtained several partial summary judgments that eliminated claims involving the roof and other interior damage, leaving only the disputed tile flooring claim for trial.
At trial, the defense then challenged the Plaintiff's explanation of how the flooring was allegedly damaged. Through witness testimony and supporting evidence, the defense questioned the credibility of the Plaintiff's account and whether the claimed damage was attributable to the hurricane.
Outcom
Following approximately three hours of deliberation, the jury returned a complete defense verdict in favor of the Defendant property insurance company. The Court subsequently entered final judgment, confirming that the Plaintiff would recover nothing on the claim.
The verdict highlights the importance of evaluating the cause and extent of disputed property damage, even when coverage has been opened for other portions of a reported loss.
