Orlando Partner Therese Savona obtained a reversal in the Fourth District Court of Appeal on a punitive damages case. The Plaintiff sued our clients, board members of a condominium association, for defamation and subsequently sought to add a claim for punitive damages. The trial court granted this relief by applying the general pleading standard to amend a complaint. On appeal, Ms. Savona successfully argued that the trial court applied the incorrect legal standard, with the appellate court agreeing that the trial court erred by failing to apply the heightened statutory standard for punitive damages.
