West Palm Beach Partner Nicole Topper represented a client in a series of permanent injunction hearings related to allegations of stalking in Palm Beach County. The cases involved three different petitioners, each bringing claims against our client.
In one case, the petitioner accused our client of stalking, including claims of threats and inappropriate behavior. Over two days of testimony, the petitioner detailed a series of incidents. During cross-examination, it became clear that the allegations did not stand up to scrutiny. Evidence and witness testimony demonstrated that the claims lacked merit, and the court determined that the petitioner had not provided sufficient evidence. As a result, the request for a permanent injunction was denied.
In a separate proceeding, another petitioner alleged stalking, threats, and property damage by our client. The petitioner described contacting police and raised further accusations. Our firm demonstrated to the court that the assertions were unsubstantiated, and it became apparent that the motive was related to internal disputes within a condominium association. The court concluded that there was no basis for a permanent injunction and denied the request.
The third case involved claims of stalking and harassment following alleged unwanted advances. During the hearing, a key witness revealed that the petitioner’s account was inaccurate, providing details that contradicted the original allegations. The court found that the evidence did not support the petitioner’s claims, and the request for permanent injunction was not granted.
Through careful examination of the facts and rigorous representation, these cases concluded favorably for our client. The court found that the evidence presented did not meet the legal standard required for issuing permanent injunctions.
