West Palm Beach Managing Partner Barry Postman and Partner Patrick Folley secured a favorable outcome in a multi-year litigation involving an alleged breach of an employment agreement. On the second day of trial, the Plaintiff agreed to dismiss the case with prejudice and without any monetary compensation.
The Plaintiff had claimed that her employer, an insurance company, violated the terms of her employment contract by improperly altering her role and subsequently terminating her for cause. The case had been actively litigated for over four years, with the Plaintiff seeking contractual damages and more than $500,000 in attorney’s fees and costs.
When the Plaintiff’s counsel approached the defense to discuss settlement on the 2nd day of trial, Mr. Postman responded that it was too late for monetary negotiations, but offered that his client would waive pursuit of fees and costs if the Plaintiff agreed to dismiss the case with prejudice. The Plaintiff accepted the offer, bringing the matter to a close.
