Tampa Partner Anna Urie and West Palm Beach Partner Jessica Anderson secured a dismissal with prejudice in the Fort Myers Division of the U.S. District Court for the Middle District of Florida. Our firm represented the Defendant, a children’s welfare agency.
The case involved allegations by the Plaintiff, a former employee, who claimed discrimination and retaliation based on age and race, as well as issues related to pay, promotion, and termination.
Initially, Plaintiff brought 12 counts in his complaint against our client, and the District Court dismissed the complaint without prejudice. Plaintiff amended his complaint, bringing seven counts against our client. Ms. Urie and Ms. DeBono Anderson moved to dismiss again, arguing that Plaintiff failed to make the necessary corrections per the Court’s initial order.
The Court carefully reviewed the allegations and, construing them in the light most favorable to Plaintiff as required, found that only one aspect of the complaint met the necessary legal standard to proceed.
