Miami Partner, Richard Adams, Jacksonville Partner, Patrick Snyder, and Jacksonville Partner, Eric Shubow, obtained a complete defense verdict in a 5 day trial in Nassau County. This was an auto accident case with disputed liability. Plaintiff, while changing from left to right lane, collided with Defendant, who was attempting to turn out of a housing subdivision into the same right lane. Plaintiff’s vehicle rolled over and slid on its roof.
Plaintiff claimed traumatic brain injury, underwent extensive therapy, pain management and a two-level cervical artificial disc replacement. Past medical expenses were $205,000 and their expert presented a $2 million dollar life care plan. The defense CME gave permanency and causation for the cervical spine and the court granted partial summary judgment on same.
Defense argued no negligence and/or comparative fault for the accident, no future care for the neck, no traumatic brain injury and no permanent injury to the lumbar spine. Plaintiff asked the jury for $23.2 million dollars. The jury deliberated for 1 hour and found no negligence on the part of Defendant.
