Case Summary
A Polk County jury considered claims brought by two plaintiffs who alleged water intrusion beneath a bedroom sliding glass door in their 2021 home. Plaintiffs asserted that resulting moisture caused widespread damage and “toxic mold,” forced them to vacate the property, destroyed all personal belongings, and rendered the home worthless. The case involved multiple construction-related defendants, including a land developer and a general contractor, both represented by CSK.
Defense Strategy
The CSK Defense Team focused on narrowing the case through targeted summary judgment motions and by excluding Plaintiffs’ key experts via Daubert challenges, ultimately preventing any mold evidence from reaching the jury. The Team preserved multiple appellate issues while consistently objecting to improper testimony and strategically relied on the weaknesses in Plaintiffs’ evidence rather than presenting witnesses. The Defense maintained that no admissible proof supported the sweeping claims originally asserted by Plaintiffs.
Outcome
At trial, the court permitted limited disputed expert opinions and testimony; however, Plaintiffs were restricted to pursuing only the cost to replace the sliding glass door and repair related damage. After just two hours of deliberation, the jury returned a verdict of less than one-twentieth of one percent of Plaintiffs’ multi-million-dollar demand, reflecting the Defense’s early dismissals, expert exclusions, and disciplined trial strategy. Plaintiffs ultimately recovered nothing on their expansive claims and now face significant financial obligations. This result underscores the effectiveness of targeted expert challenges, precise application of damages law, and strategic trial advocacy.
