Fort Lauderdale West Partner Alexander Bistritz and Miami Partner Robert Guinn secured a complete defense verdict in a first party property case involving a "random windstorm" litigated for nearly five years. Throughout the case, opposing counsel repeatedly violated court orders and was given numerous chances to comply, listing witnesses and substituting experts late multiple times. Despite our motions to compel and strike, the case proceeded to trial. During trial, opposing counsel attempted various unsavory tactics, including calling previously unlisted witnesses and trying to impeach our expert roofer with undisclosed civil lawsuit complaints. They even suggested to the jury to "just pay this man" due to supposed insurance company practices. Thankfully, the judge sustained our objections and provided curative instructions. The jury, seeing through these tactics, rendered a defense verdict in less than an hour, including lunch. Our client is ecstatic with the result, especially given the expired proposal for settlement (PFS), which was the maximum ever offered.
