Case Summary

Outcome
The court agreed with the Defendant on all counts and granted the motion to dismiss with prejudice, ending the case. The court ruled that the Defendant credit union is not a public accommodation under Alachua County law, barring the discrimination claims outright. It also found that the Plaintiffs failed to plead sufficiently extreme conduct to support emotional distress, failed to satisfy Florida’s impact rule or establish a duty of care for negligence, and failed to allege specific defamatory statements or malicious intent necessary to support defamation.
The dismissal with prejudice means the Plaintiffs cannot refile these claims, reinforcing the importance of statutory definitions and well-pled factual allegations in discrimination and related tort claims against financial institutions.
